BY ENTERING INTO THE BEAT THE CLOCK COMPETITION (THE “COMPETITION”), YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND REPRESENT THAT YOU SATISFY ALL THE ENTRY REQUIREMENTS SET FORTH HEREIN. THE COMPETITION IS PROMOTED BY THE LEXICON (THE “PROMOTER”) AND ADMINISTRATED BY NEXUS ENGAGE LTD (THE “ADMINISTRATOR”).
Competition details: No purchase necessary. The competition starts at 14:00 British Summer Time (“BST”) on 30st January 18 (“Start Date”) and closes at 23:59 BST on 29th March 2018 (“Closing Date”).
How to Enter: (1) Simply visit the interactive game located at Princess Square, The Lexicon, Bracknell (2) Play on our Beat The Clock Game (3) If you qualify, a random prize will be selected and printed on a voucher. This promotion is not open to employees (or members of their immediate families) of the Promoter, its agencies or anybody connected to the promotions.
Closing Date: The closing date for the competition is 23:59 BST on 29th March 2018 as determined by the Administrator’s computer.
Prize: The Promoter shall not be liable for any problem found with the prize or offer after receipt. Specific T&Cs might apply on the voucher.
Winner Determination: Based on your play, a prize might be selected by the Administrator’s computer.
Publicity: Winners may be required to participate in future publicity, including any updates on the competition shared in public relations activities run by the Promoter. Acceptance of any prize shall constitute and signify the winner’s agreement and consent that the Promoter may use the winner’s name, city, likeness, and/or prize information in connection with the Free Prize Draw, worldwide, including the Internet, without limitation and without further payment or consideration, except where prohibited by law. The Promoter shall not incur any liability whatsoever to the extent the Promoter chooses to refrain from any exploitation of its rights hereunder. Winners will indemnify the Promoter and the Administrator against all claims, damages, liabilities, and expenses (including reasonable counsel fees and legal expenses) arising out of any breach of the Terms and Conditions.
No exchange: The prize is non-transferable and cannot be exchanged for cash or any other alternative.
Limitation of Liability: Except where prohibited by law and to the extent that the negative consequences described below are the foreseeable result of matters within the reasonable control of the Promoter and Administrator (the “Released Parties”) and are the direct consequence of negligence, breach of these Terms and Conditions or other default by any of them, the Released Parties are not responsible for any incorrect or inaccurate entry of information, human error, technical malfunction, lost/delayed data transmission, omission, interruption, deletion, defect, line failure of any telephone, computer or other network, computer equipment, software or any combination thereof, inability to access the Website, for the inability to upload or download any Free Prize Draw-related materials from the Website, if any, or for late, lost, damaged, misdirected, delayed, garbled, inaccurate, stolen, incorrect or incomplete entries.
Further, except to the extent that any personal injury or death is caused by the Released Parties’ negligence or breach of these Terms and Conditions and to the maximum extent permitted by applicable law each entrant agrees that the Released Parties shall not be responsible for any claims, losses, liability, and damages of any kind asserted against any of them, incurred, sustained, or arising in connection with participation in this Free Prize Draw or the acceptance, use or misuse of any prize including but not limited to, any injury, death, damage, loss, or accident to person or property, or from the respective entrant’s breach of these Terms and Conditions or any agreement(s).
Each entrant acknowledges and agrees that to the fullest extent permitted by law, the Promoter and the Administrator have the right to seek damages or other remedies from any entrant responsible for such attempt if any attempt to deliberately damage any website or undermine the operation of this competition draw be made.
Privacy and Data Protection: Personal information of entrants, submitted for this competition, will be used for the purpose of the competition, confirming eligibility, announcing the winner, and prize delivery collection. Each entrant expressly agrees to the use of his/her personal information for such purpose. The Promoter and Administrator will not sell, share, or otherwise disclose this personal information collected in any manner with third parties, other than to those parties necessary to fulfill the above purposes, unless the entrant has given his/her prior express consent to receive additional information from Promoter or a third party. Personal information will be stored in a server belonging to the Administrator.
Amendment/Cancellation: The Promoter reserves the right to amend these Terms and Conditions and/or to amend, suspend or cancel the competition at any time and without prior notice.
Governing law and Jurisdiction: The competition is governed by English Law and the English Courts shall have exclusive jurisdiction.
